Ignition Interlock Devices in Alabama

When is an IID Authorized?

Alabama was the last of the 50 states to legislate the use of ignition interlock devices (IIDs). Alabama courts are required to order the installation and maintenance of IIDs for:

  • first-time offenders, if their blood alcohol levels are .15 percent or higher, they are involved in an injury type accident, a child under the age of 14 is in the vehicle or if they refuse to submit to a breath test. If a first-time offender has a .BAC of .08 or greater but less than .15, the driver can voluntarily elect an IID and a stay of the required 90 day driver’s license suspension may be granted if offender elects to maintain the device for six (6) months.
  • all repeat DUI offenders are required to install an approved interlock device on every vehicle that they own and is registered to them. Some repeat offenders with aggravating circumstances (.BAC over .15 or a child in the car may be required to maintain an IID for four to 10 years.
  • Any violation committed by an offender during the mandated ignition interlock period – for example, tampering with the device -- shall extend the duration of ignition interlock use by six months.

The offender is responsible for any and all costs associated with the IID, including installation, monthly lease payments, service fees and removal. Offenders must obtain IIDs from service providers that are certified by the State of Alabama.

The driver must provide the vehicle identification number (VIN) to the court. The offender must provide proof of installation of an approved ignition interlock device to the court within 30 days of the date the offender becomes eligible to receive an ignition interlock restricted license from the Department of Public Safety. Proof of installation includes a certificate of installation or a copy of the lease agreement for the approved ignition interlock device.
